1. Acceptance of Terms
By accessing or using SESPilot ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.
2. Service Description & AWS Relationship
SESPilot is a dashboard and interface that allows you to manage email marketing campaigns through your own Amazon Web Services (AWS) Simple Email Service (SES) account.
Important: You acknowledge that SESPilot is an independent software provider and is not affiliated with, endorsed by, or sponsored by Amazon Web Services. You are solely responsible for maintaining your own AWS account, including paying any fees charged directly by Amazon.
3. Acceptable Use (Anti-Spam Policy)
We have a zero-tolerance policy for spam. By using SESPilot, you agree that:
- You will not send unsolicited bulk emails (spam).
- You will obtain consent from recipients before adding them to your lists (Opt-in).
- You will include a valid physical address and an unsubscribe link in every marketing email, as required by the CAN-SPAM Act and GDPR.
We reserve the right to immediately terminate your account without refund if we determine, in our sole discretion, that you are sending spam or violating AWS Acceptable Use Policy.
4. Accounts and Security
When you create an account with us, you must provide accurate and complete information. You are responsible for safeguarding the password and AWS credentials (API Keys) you use to access the Service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
5. Third-Party Integrations (Canva)
SESPilot integrates with the Canva design platform to allow you to create and import designs into your campaigns.
By choosing to connect your Canva account to SESPilot, you agree that:
- SESPilot will access your Canva account information and design data based on the permissions (scopes) you grant during the connection process.
- We store your authentication tokens securely to maintain the integration.
- Your use of Canva features within SESPilot is subject to Canva's own Terms of Use and Privacy Policy.
- SESPilot is not responsible for any content created within Canva or for any data loss that occurs on the Canva platform.
6. Limitation of Liability
In no event shall SESPilot, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service;
- Any conduct or content of any third party on the Service;
- Any content obtained from the Service; and
- Unauthorized access, use, or alteration of your transmissions or content.
7. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
